Reallocation of Client Protection Fund, effective January 1, 2009

 

Client Protection Fund annual assessment will be reduced from $30 to $10 and the $20 difference will be redirected to the State Bar of Arizona operating fund. It is anticipated that this adjustment will alleviate the need to increase membership fees. Learn more about 2008-74.

Expedite Handling And Resolution Of Charges Of Lawyer Misconduct, effective January 1, 2009.

Rules 43, 44, 46-48, 53-58, 60, 61, 64, 70-72, 75

Redefines duty to deposit client funds and funds belonging to third persons; adds standards of performance including training and supervision of employees administering the account; details requirements for maintaining accounting records; addresses disbursement against uncollected funds; permits the State Bar to conduct random trust account examinations of any member’s trust account(s) in accordance with guidelines developed by the Board of Governors and approved by the Supreme Court. Procedural changes related to failure to comply with any informal request for information made pursuant to rules of procedure; procedures following screening; disposition prior to formal complaint; initial disclosure statements; and form of brief for review by the commission.  Learn more about R-06-0035. Increase Funding To Organizations That Provide Legal Services effective January 1, 2009

Rule 38(a)

The Bar shall charge 100% of member dues as the Pro Hac Vice Fee out of which 15% shall be deposited into a civil legal services fund to be distributed by Arizona Foundation for Legal Services & Education. Learn more about R-07-0029.

Emeritus Membership -- State Bar Annual Fees, effective January 1, 2009.

Rules 32, 45, 64

Members born before Jan. 1, 1939 are exempt from dues and MCLE after they turn 70. All other active members are required to meet MCLE requirements and pay dues. Includes permission for retired members to practice without being active when volunteering for an approved legal service organization. R-08-0003

Mandatory Continuing Legal Education Credit for An Arbitration Hearing,

effective January 1, 2009.

Rule 45(a)

An active member of the bar, not exempted, who serves as an arbitrator under Rule 73, Arizona Rules of Civil Procedure, is eligible for two hours of continuing legal education activity credit in lieu of financial compensation otherwise available under A.R.S. § 12-133(g) or local rule for service as an arbitrator. Such credit shall be included in the maximum number of hours allowed for self-study (maximum five hours) and shall be awarded under procedures approved by the Board of Governors. Exception For Attorneys Licensed In Another State In Rural Indigent Defense Offices, effective January 1, 2009.

Rule 38(g)

Indigent Defense Offices, as approved by the Supreme Court, in rural counties (less than 500,000) can employ two-year attorneys from any US jurisdiction as long as there is an Arizona attorney to supervise. The attorney must comply with Arizona MCLE. Permission to practice is granted for maximum of two years. Learn more about R-08-0004.

Registration By In-House Counsel, effective January 1, 2009.

Rules 38, 42, 46

The Bar is responsible for developing and maintaining a registration system and providing certificates to those in-house counsel who register.  Fee set at 75% of current dues. Submit to discipline and exempt from UPL. Learn more about R-08-0006.
